How to object to a German service-charge statement (Widerspruch)

Twelve months from receipt: how to raise specific objections, with wording for the most common items and evidence of delivery.

"Widerspruch" is the everyday German word for objecting to a service-charge statement. The statute speaks of Einwendungen — objections. The difference is more than linguistic: the point is not to reject the statement as a whole, but to name individual issues concretely. This guide explains the deadline, the structure of an effective letter and gives wording for the most common cases. It covers residential tenancies in Germany and is not individual legal advice.

The deadline

Under section 556(3) BGB you must notify objections by the end of the twelfth month after the statement reaches you. After that you can only raise objections if you are not responsible for the delay.

The period starts with receipt by you, not with the date printed on the letter. Note the day the statement arrived, diary the deadline and keep the envelope.

What the letter must contain

An effective letter has five elements: your address and the flat, the billing period and the date of receipt, the items challenged with amounts, the reason for each item, and a request with a deadline. Avoid general statements such as "the statement is wrong" — they are hard to answer and do not help later.

Say what you expect: a corrected statement, an explanation, or an appointment to inspect the documents. Set a reasonable deadline, usually two to four weeks.

The structure in five sentences

Opening: "Your service-charge statement for the period 1 January to 31 December 2024 reached me on 14 May 2025. I hereby raise the following objections within the deadline."

Then one paragraph per item. Closing: "I ask for a corrected statement by 15 June 2025 and for an appointment to inspect the underlying documents. I have transferred the undisputed back payment of €…"

Wording for common cases

Management costs: "The item 'Verwaltungskosten' of €288.00 is not a recoverable operating cost under section 1(2) no. 1 BetrKV. I ask for its removal."

Collective item: "The item 'Hausservice' of €1,240.00 cannot be followed. Please break it down by service and amount and state which part relates to maintenance and repair."

Allocation key: "No allocation key is stated for the item 'Müllbeseitigung'. Please give the total units, the units attributed to me and the calculation of my share."

Total area: "The statement gives a total living area of 800 m². To my knowledge the building has 1,000 m². Please explain the reference figure; costs of vacant flats are not to be allocated to the remaining tenants."

Heating: "The heating statement shows no measured heat quantity for hot-water preparation. Please state whether a heat meter under section 9 HeizkostenV is installed."

Deadline: "The statement only reached me on 12 February 2026 and therefore after the period in section 556(3) BGB had expired. Please explain the basis for the late assertion."

Formal and substantive objections

Two kinds of objection must be kept apart. Formal objections concern the structure of the statement: missing total costs, no allocation key, no visible calculation, no deduction of prepayments. Substantive objections concern the amounts themselves: a non-recoverable item, a wrong share, an uneconomic engagement.

This matters. The Federal Court of Justice has lowered the formal requirements: for the total costs it is sufficient to state the sum attributable to the chosen billing unit (BGH, judgment of 20 January 2016 – VIII ZR 93/15). A formally valid statement can still be substantively wrong. So set out both kinds separately rather than concluding from one formal defect that the whole statement is void.

Pay or withhold?

An objection to individual items does not automatically entitle you to withhold the whole back payment. It is often sensible to pay the undisputed part and expressly hold back the disputed amount. If you pay to avoid a dispute, you can do so under reservation — state the reservation in the payment reference and in your letter.

Note that after paying in full you cannot reclaim merely because inspection of documents was inadequate (BGH, order of 26 October 2021 – VIII ZR 150/20). So clarify before you pay.

Ask for inspection at the same time

Many objections can only be finally assessed after seeing the invoices. Combine both in one letter. The right of inspection follows from section 556(4) BGB. Where inspection is refused, you may have a temporary right to refuse performance (BGH, judgment of 9 December 2020 – VIII ZR 118/19).

Proving delivery

An objection only helps if you can later show it arrived in time. Options are a registered letter with proof of posting to the letterbox (Einwurf-Einschreiben), personal delivery against a receipt, or a messenger who knows the content. A plain email is convenient but harder to prove.

Keep a dated copy of your letter and note how and when you sent it.

Several years at once

If you notice while reading the current statement that the same item appeared in earlier years, check for each year separately whether your objection period is still running. For older statements it has often expired; then only a reclaim remains, limited by the limitation period.

Mention the pattern anyway. A line such as "the same item also appears in the 2022 and 2023 statements" makes clear that this is not a one-year slip and makes an overall solution easier.

If no answer comes

Send one written reminder after your deadline. If nothing follows, contact a tenants' association (Mieterverein) or a lawyer. For that meeting, four documents matter: the lease, the statement, your letter with proof of delivery, and your bank statements showing the prepayments.
